These Terms and Conditions govern your use of the CoolClick website and the services we provide. By using this site or engaging our services, you agree to these terms.
Services
CoolClick provides web design, development, maintenance, and related digital services. Specific deliverables, timelines, and fees are defined in individual project proposals or service agreements. These terms apply to all engagements.
Intellectual Property
Upon full payment for a project, you own the final deliverables (custom design, written content, and custom code created specifically for your project). We retain rights to pre-existing tools, frameworks, and methodologies. We may display completed work in our portfolio unless you request otherwise in writing.
Payment
Projects typically require a deposit before work begins, with the balance due upon completion or at milestones defined in your proposal. Overdue invoices may incur a 1.5% monthly finance charge. We reserve the right to suspend or remove sites for accounts more than 60 days past due.
Client Responsibilities
You are responsible for providing accurate content, timely feedback, and necessary access credentials. Delays caused by late client feedback may affect project timelines and are not our responsibility.
Hosting and Maintenance
Unless otherwise specified, hosting and ongoing maintenance are not included in project pricing and are offered as separate services. We are not liable for third-party hosting downtime or performance issues.
Limitation of Liability
Our liability for any claim arising from our services is limited to the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages, including lost revenue or data loss.
Warranty
We warrant that our work will function as described for 30 days after final delivery. Defects reported within this period will be corrected at no charge. This warranty does not cover changes made by you or third parties after delivery.
Governing Law
These terms are governed by the laws of the State of California. Any disputes will be resolved in San Diego County, California.
Changes to These Terms
We may update these terms at any time. The “Last updated” date reflects the most recent revision. Continued use of our services after changes constitutes acceptance.
